Has anyone ever used the dispute console on ebay and had a positive experience with it???
I paid for an item not recieved.
I won the DVD on Jan 11 and sent a personal check out that day.
On Jan 24, the seller cashed my check! I have the cancelled check in my hands now.
It is NOW February 15!
My emails to the seller are not being answered so I reported this to ebay a week ago.
I am extremely IRKED at this "console" so I contacted customer service on my being angry! They sent the seller ONE email a week ago and NOTHING has happened! Does this person get away with taking my money and just go on selling? He has been selling since 1999 and has very few negative feedbacks. Those few stating negative remarks got items late but mine seems to be the lead on being late!
I am STILL emailing the seller continually and there is STILL no response!
I want my DVD!

Hi,

there's still the slight chance that the seller is ill and hence neither can use his PC nor can ship your item...
... that is if the seller doesn't continue to put other items for sale onto eBay in the meantime.

P.S.: If the seller doesn't answer to the eBay-console for a month (or so), he will get banned from eBay. In other words: the console is annoyingly slow, but is working.

The only time I have used it was a 16mm print I won and waited close to two months for. A friend had won a print at about the same time from the same person and had the same problem. We both filed our complaints the same day, and about a week later, the prints showed up, showing that they had been mailed the day after our complaint had been filed. It helped us, but I'm not sure what will happen if the seller doesn't comply with the warning. Ebay makes no money from buyers, so I would guess they would give the sellers a lot of rope before kicking them off.

Start contacting some of the people who bid on this guys other auctions. I bet you get a response right away.

Linda, there is one other option you might want to try. You can get the sellers real name and telephone number. It is under the contact member and you enter the auction number and the online seller's ID. Ebay Emails you the information. You can try making a telephone call. I did this once on a slow ship and the seller did anser but was terse but I did get the item.

Good idea, David. I have the seller's real name since I wrote him the check but, I am afraid if he hangs up on me, I will totally lose control.

Believe it or not, I had a dream about this last night. I received the DVD in the mail and the seller even gave me my money back -talk about a fantasy!! This is how much it is bothering me, I am dreaming about it!

The positive feedbacks he received is why I thought I could buy from him with no problems! He is supposedly a fast shipper and replies to all emails! Now it just burns me up!:mad:

Even though I thought I was saving money in getting this on ebay, I made more stress in my life!

Just call the seller on the phone and give him a fair opportunity to tell you that his SPAM filter ate all of your emails. You'd be surprised how often this happens. :mad:

If you don't get satisfaction over the phone, follow up with eBay to get your money back. Of course, if you had paid with a credit card you'd have more immediate recourse via PayPal and/or your own bank.

I actually have some good news!
I just received an email from the seller's wife with a sincere apology.
Apparently, they have been without a home computer for several weeks and she explained it was an oversight on not sending my DVD out after my check cleared weeks ago.
My DVD is getting shipped immediately.
I guess ebay dispute council FINALLY heard my ANGER after my email was sent out to their "contact us" center this morning!

I closed the dispute today. I FINALLY received my DVD! I don't want to give them a negative feedback since the seller might want to give one back to me, as a payback. Any suggestions on what to write as a feedback?? I will never again buy anything from this seller.

Why leave any feedback at all? You WANT to leave a negative, but won't out of (valid) fear of receiving a retaliatory negative - so leave NO feedback.

Seems to me to be a VALID explanation of the situation. I would leave positive feedback, since you did get your item and are satisfied. Just don't do business again with the seller if that's your perogative.

You might also check their feedback right now, before leaving any, to see if other buyers had similar problems and what resolution there was. If you see a big block of sudden negatives in a sea of otherwise positive comments, then the seller may have indeed had a problem out of their control.

In any event, I see no reason for you to even consider a negative.

You could even leave a positive indicating shipping was slow but that the seller acknowledged they had hardware problems. Shit DOES happen.

The seller did have computer problems but admitted they forgot my check cleared which irkes me to no end! It is very irresponsible in my opinion!!!

I still am unsure of what to do, which is why I asked you wonderful people for assistance.

Then yor feedback should be left accordingly.

If you want to find out if the seller "strikes back", go to their feedback, and click on the "Feedback left for others" tab and see they leave negatives for others, and try to cross reference them back to the other buyer.

No, the seller did not strike back on the last two negative remarks but there is a first for everything!
I am waiting to see if they leave feedback for me and then maybe I will know what to do.

Or leave a positive feedback with a remark like this: "delivery took very long (8 weeks), but DVD finally arrived in good shape".
(I just guessed the "8" weeks)
